Terms of Service

Welcome to Property Media Group, LLC. By accessing our website or placing an order for photography, videography, 3D tours, or any other media service, you agree to be bound by these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By creating an account, submitting an order, or using any part of our platform, you confirm that you are at least 18 years of age, have the authority to enter into a binding agreement, and accept these Terms in full. If you are acting on behalf of a real estate brokerage, agency, or business entity, you represent that you have authority to bind that entity.

2. Services Description

Property Media Group, LLC provides professional real estate media services including, but not limited to:

• Interior and exterior photography
• Aerial/drone photography and videography
• 3D virtual tours (Matterport-compatible)
• Floor plans (2D and 3D)
• Twilight and virtual twilight photography
• Virtual staging and photo enhancement
• Social media reels and listing videos

Service availability may vary by geographic area. Property Media Group, LLC reserves the right to modify, suspend, or discontinue any service at any time with reasonable notice.

3. Booking & Cancellation

Scheduling: Orders must be placed with at least 24 hours advance notice. Same-day scheduling is subject to availability and may incur an expedited service fee.

Cancellations: Cancellations made more than 24 hours before the scheduled shoot are free of charge. Cancellations within 24 hours, or no-shows, are subject to a cancellation fee of up to 50% of the order total.

Rescheduling: One reschedule is permitted at no charge with at least 24 hours notice. Additional rescheduling requests may incur a fee.

Weather: Exterior shoots may be rescheduled due to inclement weather at no charge to the client. Mutual agreement on a new date is required.

4. Payment Terms

All orders require payment at the time of booking unless a credit account has been established. We accept major credit cards and ACH transfers. All prices are in USD.

Invoices for enterprise or brokerage accounts are due within Net 30 of the invoice date. Late payments are subject to a 1.5% monthly finance charge.

Property Media Group, LLC reserves the right to withhold final media deliverables until payment has been received in full.

5. Intellectual Property & Licensing

Upon full payment, Property Media Group, LLC grants the client a non-exclusive, non-transferable, royalty-free license to use the delivered media for real estate marketing purposes, including MLS listings, social media, and print materials related to the specific property photographed.

Property Media Group, LLC retains full copyright ownership of all photographs, videos, and other media produced. The client may not:

• Sell, license, or transfer the media to third parties
• Use the media for advertising services other than the subject property
• Remove or alter Property Media Group, LLC watermarks or metadata without written consent

Property Media Group, LLC reserves the right to use any delivered media in its portfolio, marketing materials, and social media channels unless a written opt-out request is received within 7 days of delivery.

6. Delivery & Revisions

Standard delivery is within 24–48 business hours following the scheduled shoot. Rush delivery (same day or next morning) is available for an additional fee.

Each order includes one round of minor revisions (exposure adjustments, minor retouching). Significant edits, virtual staging additions, or structural changes are billed separately.

Delivered media is provided via a secure download link valid for 30 days. Re-download requests after expiration may be subject to a retrieval fee.

7. Limitation of Liability

Property Media Group, LLC's total liability for any claim arising from services shall not exceed the total amount paid by the client for the specific order in question.

Property Media Group, LLC is not liable for:

• Lost sales, lost listings, or other indirect or consequential damages
• Property access issues caused by the listing agent, seller, or lockbox failures
• Delays caused by weather, equipment failure, or force majeure events
• Data loss due to circumstances beyond our reasonable control

8. Governing Law & Disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, with proceedings conducted in Houston, TX.

Notwithstanding the above, either party may seek injunctive relief in a court of competent jurisdiction to protect intellectual property rights.
